Terms and Conditions for Soul of Scotland Tours
The following terms and conditions form the basis of the contract between the Operator and its customers. In these terms and conditions ‘the Operator’ refers to Soul of Scotland Tours, a ministry of Christian Heritage Edinburgh, Scottish Charity SCO44844, and the ‘Group Leader’ refers to the person designated by a group as their leader, or the individual who is booked to attend/or attends any tour.
2. Booking Procedure
All bookings should be paid by the method requested on your booking confirmation by Soul of Scotland Tours. Where this is not possible, payment should be made in consultation with the Operator (contacted by email; email@example.com, or by telephone: 07985 070899). All group bookings must be made in writing (which includes email) at least 30 days before the requested tour. The exception to this is the Celtic Tour, which can be booked on the day, either through our website booking system, or by turning up on the day at the meeting place. (Please be reminded that the Celtic Tour only runs between June and September, Tuesdays and Thursdays, at 3 pm). It is also possible for individuals to join groups and book a place on any of the other tours up to 48 hours before the tour date, unless the group booked is an Exclusive Group. An Exclusive Group can be booked, but with an extra charge, to be arranged between the Operator and Group Leader.
3. Group Booking
Groups are to be booked through the Group Leader who will liaise with the Operator. A tour group must be booked at least 30 days before the scheduled date. A deposit of 50% of the total cost of the tour group is required when the Group Leader books with the Operator. The full amount must be paid at least 14 days before the scheduled tour. Failure to do so will be deemed by the Operator as a cancellation of the scheduled tour and no refund will be made by the Operator. All bookings paid on time will be confirmed by the Operator in writing (which includes email).
4. Cancellation by You
If the Group Leader cancels at least 14 days before the scheduled tour, the full deposit or payment will be refunded. If the Group Leader cancels less than 14 days before the schedule tour, but more than 7 days before the scheduled tour, 50% of the full tour payment will be refunded. If the Group Leader cancels less than 7 days before the scheduled tour, no refund will be made.
5. Cancellation by Us
If, for some unforeseen circumstance, we have to cancel a scheduled tour, then the full amount payable for the tour will be refunded to the Group Leader. If the tour on the scheduled day has to be cancelled because of terrorism, civil unrest, industrial disputes or dangerous weather, then the full payment for the tour will be refunded. All customers should also be advised to be covered by their own insurance.
6. Changes by You
If a group decides to change to a different tour, the Group Leader must inform the Operator at least 14 days before the scheduled tour. Failure to do so will result in the loss of all payment made to the Operator.
7. Changes by Us
The Operator reserves the right to make changes in regard to what it deems the best and most appropriate way of serving the customers. The Operator reserves the right to change the prices of its tours, but if a Group Leader or individual has already booked a scheduled tour before this, then there will be no price change for this group or individual.
8. Missed Departures
All persons scheduled for a tour must be at the agreed meeting place at least 15 minutes before departure. We aim to leave promptly and the Operator cannot be held responsible for any group or individuals that are late. In any case of a group or person missing the departure time, the Operator will not refund the tour payment.
9. Refusal of Travel and Tour
The Operator has the right to refuse a tour and travel to anybody whom the Operator deems to be under the control of alcohol, drugs or addictive substances in a way that causes harm or may cause harm, offence or insult to any of the other passengers, the Operator and/or tour company staff. In such cases the Operator will not refund any payment.
10. Disabilities and Medical Problems
It is the responsibility of all customers to make sure that they bring their own medical treatments with them, if they require them, and that the Operator is informed at least 48 hours before a scheduled tour of any customers with disabilities who need assistance for such things as wheelchairs.
11. Dietary Requirements
Customers should alert the Operator to any special dietary requirements for the Mystery and Medieval Tours, and the Group Leader must inform us at least 48 hours ahead of the scheduled tour.
All children (under the age of 16) must be accompanied by parents or guardians.
We run a non-smoking policy both on board the bus and in any buildings we enter.
Passengers on the bus shall be limited to one small rucksack or bag, and should not bring any suitcase/s.
In the case of any complaints about the Operator, full reasons with evidence must be submitted in writing to the Operator up to 28 days after the event. Any time after this 28 day period will be considered invalid.
16. Insurance and Liability
All customers on the Operator’s tours must be responsible for their own passports, visas and belongings and have their own travel and health insurance. While the Operator will make every effort to ensure your safety, people coming on the tour do so at their own risk. Customers should wear practical shoes for walking and bring raincoats as Scotland is well known for its regular rain.
Unless expressly stated otherwise in these terms and conditions, we will not have any liability to you if we are prevented from fulfilling our contractual obligations to you as a result of any event which is outwith our control (and/or outwith the control of the supplier or provider of the service in question). Such events may include (but are not limited to) war or threat of war; terrorist activity or the threat of terrorist activity; civil commotion or riot; any action taken by a governmental or public authority; industrial disputes; collapse of buildings, fire, explosion or accident; traffic or road conditions or road closures; technical or mechanical breakdown; adverse weather conditions; natural disasters and all similar events or circumstances.
Except for liability for death or personal injury caused by the Operator’s negligence, the Operator shall under no circumstances whatever be liable to the Group Leader, any customer or member of a tour group, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any tour and the total liability to the Operator in respect of all other losses arising under or in connection with this contract, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the amount actually received by the Operator.
The Group Leader hereby agrees to indemnify the Operator for any and all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) suffered or incurred by the Operator arising out of or in connection with any breach of the terms of this contract and/or the actions or omissions of the Group Leader and/or any member of his/her party during or after the tour.
17. Data Protection and Privacy
We run a data protection policy and will not pass on the details of any of our customers to any third party.
18. Governing Laws and Jurisdiction
The terms and conditions are governed by Scottish law and in the case of any dispute all parties must submit to the exclusive jurisdiction of Scottish courts and Scottish law.
